Primordial Radio Terms of Use
Primordial Radio’s subscription service gives members access to:
- All features and functionalities available on Primordial Radio platforms
- First and exclusive access to all Primordial Radio audio and video content streamed over the internet
- First and exclusive access to ticket offers
- Ten percent (10%) discount on all merchandise and events less the Primordial Radio Pub Quiz
- Full access to all members-only sections on www.primordialradio.com and user interfaces.
Primordial Radio service is provided by FT Industries, a UK limited liability company. These Terms of Use govern your use of our
service. As used in these Terms of Use, “Primordial Service” or “the service” means the service provided by Primordial Radio for
discovering, watching, and contributing to Primordial Radio content.
1. Membership
Your Primordial Radio membership will continue year to year or month-to-month until terminated. To use the service you must have
Internet access and provide a current, valid, accepted method of payment, which you may update from time to time (“Payment Method”). Unless
you cancel your membership before your monthly billing date, you authorize us to charge your next month’s membership fee to your Payment
Method (see “Cancellation” below).
2. Free Trials
2.1 Your Primordial Radio membership may start with a free trial. The free trial period of your membership lasts for 30 Days,
or as otherwise specified during sign-up and is intened to allow new members and certain former members to try the service.
2.2 Free trial eligibility is determined by Primordial Radio at its sole discretion and we may limit eligibility to prevent free
trial abuse. We reserve the right to revoke the free trial and put your account on hold in the event that we determine that you are not
eligible. Members of households with an exisiting or recent Primordial Radio membership are not eligible. We may use information such as
device ID, method of payment or an account email address used with an existing or recent Primordial Radio membership to determine eligibility. For
combinations with other offers, restrictions may apply.
3. Billing
3.1 Billing Cycle. The membership fee for the Primordial Radio service and any other charges you may incur in connection with
your use of the service, such as taxes and possible transaction fees, will be charged on an annual or monthly basis to you Payment Method on
the calendar day corresponding to the commencement of the paying portion of your membership. In some cases your payment date may change, for
example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month.
3.2 Payment Methods. You can change your Payment Method by visiting your World Pay account. If a payment is not successfully settled, due
to expiration, insufficient funds, or otherwise, and you do not change your Payment Method or cancel your account, we may suspend your access to the
service until we have obtained a valid Payment Method. When you update your Payment Method, you authorize us to continue charging the updated Payment
Method, and you remain responsible for any uncollected amounts. This may result in a change to your payment billing dates. For some Payment Methos, the
issuer of you Payment Method may charge you certain fees and taxes depending on the Payment Method used. Check with your Payment Method service provider
for details.
3.3 Cancellation. You can cancel your Primordial Radio membership at any time, and you will continue to have access to the service through
the end of your annual/monthly billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds
or credits for any partial-year/partial-month membership periods.
3.3.1 If you pay via Worldpay, to cancel, go to World Pay account and follow the instructions for cancellation. If you cancel your
membership, your account will automatically close at the end of your current billing period. To see when your account will close visit your World Pay account.
3.3.2 If you pay via Direct Debit (GoCardless), to cancel, close the direct debit via your bank. You may find billing information about your
membership by visiting your account page.
3.4 Changes to the Price and Service Plans. We may change our service plans and the price of our service from time to time; however, any price
changes or changes to our service plans will apply to you no earlier than 30 days following notice to you.
Primordial Radio Mobile App
FT Industries gives no warranty as to description, quality, fitness for any particular purpose, and all such warranties expressed or implied by law
shall, to the fullest extent permissible by law, be excluded. You acknowledge that the SOFTWARE PRODUCT is not error-free and agree that the existence
of such errors shall not constitute a breach of this Agreement.
This software is provided “as is” and without warranties as to performance or merchantability.
The user is advised to test the program thoroughly before relying on it. All due care is taken to store data securely but the user must assume the
entire risk of using the program. Any Liability of the seller will be limited exclusively to product software replacement or refund of purchase price.
The user undertakes not to copy, reproduce, translate, reverse-engineer, adapt, vary or modify the SOFTWARE PRODUCT nor make it available in any form to
any other person through re-sale or otherwise except with the prior written consent of FT Industries.
FT Industries reserves the title, ownership and all rights and interests to any intellectual property or work product resulting from its use and analysis of such information.
The above terms constitute the entire agreement between you and FT Industries (Company No: 10638661) with regard to the Software, which you accept by clicking on ‘Yes’ below,
and such agreement may not be modified except in writing and agreed by both parties. If any provision of this agreement is invalid or unenforcable under applicable law, it
is to that extent deemed omitted and the remaining provisions will continue in full force and effect.
